Amazon to stop accepting UK-issued Visa credit cards

In a statement, a spokesperson for the retailer said: “The cost of accepting card payments continues to be an obstacle for businesses striving to provide the best prices for customers. These costs should be going down over time, with technological advancements, but, instead, they continue to stay high or even rise.

Amazon has announced that it will stop accepting Visa credit cards starting 19 January 2022 "due to the high fees Visa charges for processing credit card transactions". This is a highly unusual move by one of the biggest online retailers, clearly aimed at reducing costs, while restricting consumer choice and payments, but demonstrating the shifting dynamics in payments.

What has happened?

According to the BBC, Amazon is offering £20 for Prime customers to switch from using Visa to an alternative payment method, and £10 for other customers, if they have a Visa cards as their default or only payment method on their account.

This unexpected move has a number of causes, and effects, on both merchants and consumers  , and illustrates the changing payments landscape: 

Costs reduction 

Credit cards do carry a higher interchange fee than debit cards – they are capped at 0.3% for credit cards, as compared with 0.2% for debit cards. 

Amazon has said that Brexit is not the specific cause of the dispute, but it is likely to be part of the reason: following the UK's withdrawal from the EU, these caps ceased to apply to cross-border UK/EU card payments, following which both Visa and Mastercard changed their charging regimes for online card payments between the UK and the EU, with Visa's charges increasing to 1.5% for credit cards and 1.15% for debit cards. 

So while UK card holders will not notice any difference, an EU merchant will now be facing significantly increased fees for transactions by UK card holders., the website, is owned and maintained by Amazon Europe Core Sarl, a Luxembourg company, with another Luxembourg company, Amazon EU Sarl, also involved.

Merchants are free to determine what methods of payment they are willing to accept (card payments, PayPal or similar, direct debit, bank transfer, cheque, or cash). They are also free to offer discounts for different methods of payment, and often do for switches to direct debit. 

However, merchants in the UK and the EU are, broadly speaking, prohibited from applying surcharges for the use of www edd benefits payment methods. This means that UK merchants cannot charge more for credit card payments, as compared with, for example, debit card payments.

Reduced choice and protection

Amazon's move clearly reduces consumer choice. If a customer moves to a different payment method, such as a debit card, they will also cease to enjoy section 75 Consumer Credit Act (CCA) protection for all of their Amazon purchases. 

This rule protects customers, typically where they use a credit card to buy goods or services between £100 and £30,000, by allowing them to claim against the credit provider instead of the supplier. This may matter less for goods and services of lower value and for those delivered and consumed very quickly, however, it is a notable loss of protection.

Class Action Alleges Amazon Charged Customers for Unauthorized Prime Memberships

Class members of the lawsuit allege that Amazon wrongfully charged them for Amazon Prime memberships. The plaintiffs further claim that Amazon engaged in amazon digital services credit card charge advertising of its services. This is not the first time Amazon has been sued in connection to its Prime memberships. The current lawsuit suggests that there may be more to come.

The Lawsuit’s Allegations

The recent class action lawsuit filed earlier this month consists of a group of Amazon customers from California and Texas. The plaintiffs allege that Amazon deceived them into paying for unwanted Prime memberships. They claim they purchased products from Amazon. The company then charged them for Prime memberships for years without their knowledge or consent. Once the plaintiffs discovered the unauthorized charges to their accounts, they allege that Amazon refused to provide refunds. According to the complaint, Amazon represented to its customers that Amazon would not charge them for the Prime membership. No written terms regarding the price of membership were provided to plaintiffs. The complaint alleges that Amazon “knew that their representations and omissions were untrue and misleading, and deliberately made the aforementioned representations and omissions in order to deceive reasonable consumers.”

The lawsuit, Laura Makenna, et al., v. LLC, 17-CV-04412, was filed in the United States District Court for the Northern District of California. Another Lawsuit Against Amazon

The plaintiff in Latoya Christmas v. LLC, et al., 17-CV-01301, filed in the U.S. District Court for the Northern District of Illinois, alleged that Amazon charged her debit card, without her consent or knowledge, for the purchase of Amazon goods and a $99 Amazon Prime membership. Amazon agreed to cancel the Prime membership and refund the $99 fee. However, Amazon then withdrew another $99 from the plaintiff’s bank account, which Amazon never credited back.

According to the complaint, Amazon “concealed, suppressed and/or omitted” the fact that Amazon amazon digital services credit card charge the plaintiff an additional $99 fee despite her cancellation of the Prime membership. The complaint alleges that these actions constitute a “common scheme to mislead consumers and incentivize them to purchase products from its website.” The complaint further alleges that Amazon violated the California False Advertising Act by “making misrepresentations and untrue statements about its services, namely…that it would not charge [customers] for membership fees in order to purchase products on its website, and made false representations to Plaintiff and other putative class members in order to solicit these transactions.”
